Protecting Your Child
The majority of parents in Texas have not named a gaurdian for their child. If something happens, and you haven't designated a guardian, a Judge will be forced to choose one for you. Without your input the Judge may even choose someone you would never want to take care of your child. Naming a Guardian in Your Will is Not Enough
Even responsible parents who have named a guardian for their child are often surprised at the ways their children would still be at risk in the event of their untimely death. As a single parent of young children our estate planning attorney knows too well the challenges that traditional planning (or none at all) bring. We ensure that any plan we design provides for your children to be taken care of by the people you want with clear expectations of how you want them raised.
When children are not covered by an adequate plan, they face a multitude of risks. First, even when you have chosen a guardian, your children can end up in Child Protective Services (CPS) custody while the details are being figured out. Also the process of deciding on the gaurdian can be quite expensive, depleting resources that would have otherwise been available for support. And, when there is not guardian chosen, a Judge has to decide what is best for your children without your input.
Often the children will gain full access to any remaining assets when they turn 18. Aside from a lack of maturity at that point, their inheritance is part of the public record. They will face the possibility that someone has reviewed the record and is set on taking advantage of them.
As a parent, our estate planning attorney knows what it takes to thouroughly protect your child.
